In accordance with the directive issued by the Islamabad High Court (IHC), the Capital Development Authority has banned the property transfer prohibition.

Revocation of the prohibition first imposed in January 2024 by the Deputy Director General Land has been verified in a letter from Riaz Khan, Additional Director Land Affectees.

A transfer restriction existed informally for a few months prior to the legal prohibition on property transfers associated with land affectees taking effect in January 2024. At first, the ban was intended to prevent the transfer of properties allotted to land affectees while Afnan Alam Khan, the former Member Estate, was in office.

But it spread to a lot of other situations, leaving hundreds of customers in the dark. Plots were either dispersed by the CDA through public auctions or allotted to impacted persons who then sold them on the open market.

These people got plots as compensation for having their land purchased by the CDA. For plots assigned to individuals impacted by land, the open auction method of transferring plot ownership worked without any problems.

Due to the restriction on title transfers in the land affectees’ sector, the Real Estate Agents Association strongly objected and stated their concerns at the civic authority’s location.

Even though the association met with the then-Member Estate, Captain (Retired) Anwar-ul-Haq, and the Chairman CDA, their complaints went unanswered.

Instead of stopping the process altogether, the Real Estate Agents’ Association stressed the importance of identifying particular cases of misconduct and holding those involved accountable. After then, a few people went to the Islamabad High Court, which ordered the municipal government to start giving individuals assets right away, stating that they had an indisputable claim to them.

Realtors are dubious about the CDA’s intentions even after it issued a notification; they believe the notice was sent out in response to court orders.

In the days to come, they anticipate more information to be available. A subordinate officer such as the Additional Director Land Affectees revoked the ban, which was first enforced by the DDG Land, and an insider claims that this is cause for concern. This seems like a higher-up’s unwillingness to follow the court directives to the letter.

Afnan Alam Khan, a former member estate, and many other officers from the land and rehabilitation directorate were the subject of a Federal Investigation Agency (FIA) probe into an incident. In this case, land valued at billions of rupees was allegedly fraudulently allotted in sector E-11.

But instead of focusing only on specific cases, the anti-corruption agency has asked the CDA for complete records of all allocations, plot location modifications, and other pertinent information during his term.
