Consumer Body Seeks Ban on Ads for Unapproved Real Estate Projects

ISLAMABAD: The Consumers Association of Pakistan has called for legislation to restrict advertisements for residential and commercial real estate projects that have not obtained the necessary approvals from the relevant development authorities.

The consumer body has raised concerns that property buyers can be attracted by promotional offers such as discounts, prizes and other incentives before they have confirmed whether a project has the required legal permissions.

According to the association, buyers may also face difficulty determining whether a developer actually owns the land being marketed or has obtained the approvals needed to develop and sell plots, houses or commercial units.

The proposed advertising restrictions are aimed at addressing this issue before buyers commit their money. Under such a framework, developers and marketers could potentially be required to disclose approval information and relevant NOCs before promoting a project to the public.

However, the proposal has not yet become a government regulation or law. No confirmed legislation, implementation date or enforcement mechanism has been announced following the association’s demand.

If authorities consider the proposal, several practical issues would need to be addressed, including which agencies would verify project approvals, what information advertisements must contain and what penalties would apply to violations.

The call comes amid enforcement actions against unauthorised housing schemes in different parts of Pakistan. Development authorities and district administrations have increasingly warned buyers about projects operating without required approvals.

For property buyers, the latest demand reinforces the importance of conducting independent checks before making a booking or purchasing a plot. Promotional prices, limited-time offers or other incentives should not replace verification of a project’s approval status.

Buyers should confirm the NOC, approved layout plan, land ownership and transaction permissions with the relevant development authority. Until any new legislation is formally introduced, the existing regulatory framework and official notifications remain applicable.

The proposal could lead to greater disclosure requirements for real estate advertising if lawmakers or regulators decide to take it forward. For now, it remains a recommendation from the consumer body rather than a confirmed change in property advertising rules.
