The Federal Constitutional Court has issued an important judgment aimed at improving transparency in public institutions and strengthening the rights of government employees across Pakistan.
The court has directed all government departments and autonomous bodies to publish updated seniority lists on their official websites every year, making this information publicly accessible.
Seniority Information Declared a Fundamental Right
In its ruling, the court stated that access to seniority records is a constitutional and fundamental right for both citizens and government employees.
It further emphasized that public institutions cannot withhold such information, as transparency is essential for fair administration and accountability within government systems.
Merit-Based Seniority Rules for Same-Batch Employees
The judgment also clarified how seniority should be determined for employees recruited in the same batch.
According to the court:
- Seniority must be based strictly on merit ranking
- The “first come, first served” principle cannot be used
- Merit-based evaluation ensures fairness in recruitment and promotion processes
The court observed that administrative fairness requires objective criteria rather than procedural timing differences.
Port Qasim Authority Seniority List Declared Invalid
In the same ruling, the court declared the seniority list issued by the Port Qasim Authority null and void.
It also set aside the earlier decision of the Sindh High Court and accepted the appeal filed by Captain Muhammad Ali Khan.
Annual Updates and Strict Compliance Required
The court has directed all federal and autonomous institutions to:
- Update seniority lists every January
- Revise lists immediately after recruitment, promotion, or regularization
- Ensure all records are published online for public access
Provincial chief secretaries have also been instructed to ensure full implementation of the judgment across departments.
Push for Greater Transparency in Governance
The ruling is being seen as a step toward strengthening administrative transparency and improving governance standards in public sector institutions.
By making seniority records publicly available, the court aims to reduce disputes, improve accountability, and ensure fair treatment of employees across Pakistan.
