ISLAMABAD: The Supreme Court of Pakistan has set aside an earlier Sindh High Court judgment in a long-running dispute over ownership of a 1,000-square-yard property and ordered the case to be heard afresh, preferably within six months. The decision, reported on October 25, 2026, raises questions about the Sindh government’s claim to the property but does not deliver a final ruling on ownership.

The property was reportedly purchased in 2011 through two registered sale deeds, while the Sindh government occupied the premises as a tenant. The government later challenged the owner’s title, arguing that an earlier land auction had been cancelled in 1974.

During the proceedings, Justice Muhammad Ali Mazhar questioned why the government had not raised its ownership claim earlier. The court also observed that an oral assertion about the cancellation of the auction, without sufficient supporting evidence, could not by itself establish ownership rights in the tenancy case.

The Supreme Court referred the matter back for fresh adjudication after setting aside the Sindh High Court’s previous judgment. The court’s order leaves the ownership question unresolved, and the available reports do not identify the forum that will conduct the rehearing.

The case highlights the importance of reliable property records, registered sale deeds and documented evidence in disputes involving ownership and tenancy. Property owners, buyers and tenants may find the proceedings relevant when reviewing competing title claims or older auction records.

The next hearing and the evidence presented regarding the alleged 1974 auction will be important to the case’s outcome. Until a fresh decision is issued, the dispute over the property’s legal ownership remains unresolved.
