CDA Seeks Martial Law Regulations in Tree Cutting Case
The Capital Development Authority (CDA) has reportedly requested the Islamabad High Court (IHC) to preserve the Martial Law Regulations in a case involving the cutting of trees in the federal capital.
In a lawsuit against the owner of a private housing project, the CDA’s council petitioned the IHC to stop the Additional District and Sessions Judge (ADSJ) from granting bail and overturning the senior special magistrate’s verdict.
According to reports, CDA petitioned the court on the grounds that, according subclause 2 of section 6 of Martial Law Regulation No. 82 of 1960, the ADSJ lacks the power to overrule CDA’s verdict. In response, the CDA council sought that the IHC reinstate the CDA’s verdict by imposing a 1.5 billion PKR fine and a three-year prison sentence.

The litigation was initiated when a complaint was filed against the owner of a housing development for cutting down trees for construction reasons in the surrounding area. However, the ADSJ granted the owner bail in exchange for $600,000 in surety bonds and reversed the CDA’s verdict.
