Installation of Phone Tower in Park Challenged in PHC
A resident of Peshawar has petitioned the Peshawar High Court against the erection of a mobile phone tower in a park in Defence Officers Colony, claiming that it poses a health concern to local residents.

Dr. Khalid Shah, a resident of Defence Colony, petitioned the court to declare illegal and unconstitutional the installation of the mobile phone tower near his residence in Defence Park.
He asked the court to prohibit the installation of cell phone towers/base transceiver stations in residential areas and near schools and parks.
The petitioner also requested interim relief from the court, demanding that the corporation refrain from building the tower in the aforementioned park until the final disposition of his petition.

In 1998, the International Commission on Non-Ionizing Radiation Protection issued international guidelines for the installation of cell towers, and in furtherance of those, national guidelines were issued, both of which require that cell towers be placed at a safe distance (specified in the guidelines) from residential homes, public areas, and schools.
The petitioner asserted that the EPA had just developed Guidelines for Installations of Base Transceiver Station (BTS) Sites, but they were not being followed in this instance.
