SC Announced Elections in Punjab, KP to be Held in 90 Days

Islamabad: The most recent information is that the Pakistani Supreme Court (SC) ruled on Wednesday, by a vote of 3-2, that elections in Khyber Pakhtunkhwa and Punjab must be held within 90 days. Since the provincial assemblies were dissolved in January 2023, caretaker governments have been in place in both provinces.

“Parliamentary democracy is a distinctive component of the Constitution,” the Supreme Court ruled. Without the Parliament or the provincial assemblies, there cannot be a parliamentary democracy. And without the holding of general elections as intended, necessary, and mandated by and under the Constitution and in line therewith, neither the Parliament nor provincial assemblies are possible.

Because the governor did not dissolve the legislature, the president’s April 9 date in Punjab is “constitutionally competent.”
Election Control Panel (ECP) must suggest a date that “deviates to the barest minimum” from the deadline if elections cannot be held within 90 days.
After consulting with ECP, the president will declare a date for the Punjab elections.
Because he followed the chief minister’s suggestion and disbanded the legislature, the governor of Khyber Pakhtunkhwa is required to consult with the ECP before announcing the date, thus the president’s date is invalid.
The president or governor must be able to contact ECP “proactively” for consultation on necessary dates.
